In Re: ——, Roman, (U.S. Citizenship & Naturalization Service, July, 2011). Legal challenge: A conditional permanent resident filed an application to remove conditions on his residency with different counsel. The U.S. Citizenship & Naturalization Service (“USCIS”) issued a notice of intent to deny the application and rescind his resident status on the basis that his marriage was fraudulent. Action taken: Chicago Immigration Advocates took over the case and filed a response to the intent to deny. The response countered USCIS’s allegations of marriage fraud and alleviated its concerns about the applicant’s marriage. Result: USCIS removed the conditions upon our client’s residency and he is a permanent resident without conditions and planning on applying for naturalization.
