In Re: ——, Octavio, (U.S. Department of State, 2011). Legal challenge: Our client was placed in deportation proceeding for failing to marry his wife within his first 90 days of entry into the United States, pursuant to the terms of his K-1 visa. Our client was not eligible to adjust his status in the United States. Action taken: In the Immigration Court Chicago Immigration Advocates persuaded the judge to give our client voluntary departure so that he could return again, this time on an immigrant visa based upon marriage. Following our client’s departure, Chicago Immigration Advocates filed applications for an immigrant visa and a waiver of his prior unlawful presence in the United States based upon the extreme hardship on his U.S. citizen spouse and child. Result: The US Citizenship & Naturalization Service granted our client’s waiver application and he will soon be reunited with his family in the United States as a permanent resident.
