The H-1B is a non-immigrant visa in the United States under the Immigration & Nationality Act, section 101(a)(15)(H). It allows U.S. employers to temporarily employ foreign workers in specialty occupations.
The current law limits to 65,000 the number of aliens who may be issued a visa or otherwise provided H-1B status. (The numerical limitation was temporarily raised to 195,000 in FY2001, FY2002 and FY2003.) In addition, excluded from the ceiling are all H-1B non-immigrants who work at (but not necessarily for) universities and non-profit research facilities.
H1-B EMPLOYMENT VISA
An employer can bring a foreign professional to legally work in the United States on an H1-B work visa. The individual seeking to work may not petition for him or herself, but must be sponsored by an employer. The visa is valid for 3 years, and may be extended for a maximum of 6 years. If you are currently in the US under a different non-immigrant status, such as an F-1 Student Visa, you have the option of changing to an H1 status. If you currently have a valid H1 Visa with employer A, you have the option of transferring your H1 Visa to employer B, without being subject to the annual cap. An advantage to an H1-B visa is that it allows a person to legally remain in the US for employment purposes. It also allows them to travel inside or outside the United States, or remain here until the visa expires. H-4 Visas are available for accompanying family members of H1-B holders.
